Ross Nasseri’s lawyers have years of experience litigating and winning injunctions. We have successfully moved for and resisted every kind of urgent relief under Canadian common law including Mareva orders (asset-freezing), Anton Piller orders (civil search warrants), Norwich orders (disclosure orders), emergency appointments of Court-appointed officers such as Receivers and Restructuring Officers, trespass injunctions, interim and interlocutory orders for accounting and for the return of assets, Certificates of Pending Litigation to encumber real property, and passport surrender orders.

Wayne Safety Inc. v. Diana Gendelman et al., 2023 ONSC 3517 and Wayne Safety Inc. v. Gendelman, 2023 ONSC 2478: Our team successfully sought Mareva, Anton Piller and Norwich relief together with multiple certificates of pending litigation and passport surrender orders against the defendants in a case involving a multi-million dollar fraud
Kiosk Design Inc. v. El-Riffaey, 2024 ONSC 2373: We were successful in obtaining Mareva and Norwich relief to obtain disclosure of the bank accounts of a defendant involved in an alleged fraud/misappropriation of funds. The defendant’s house was included in the frozen assets under the Mareva
University of Toronto (Governing Council) v. Doe et al., 2024 ONSC 3755: We acted for two interveners in supporting a successful property injunction to restrain trespasses being committed by persons involved in a protest encampment on campus grounds belonging to the University of Toronto
Carbone v. Boccia, 2022 ONSC 6528, 2023 ONSC 54, 2023 ONSC 3625: We successfully moved for Mareva injunctions and Norwich Orders in a strongly contested case of fraud
Axess Law Professional Corporation v. u Consulting and Closing Services Corp. et al.: We acted for a law firm and obtained an order for injunctive relief to restrain a departing employee from conducting a copycat business that made use of stolen confidential information including client lists and marketing copy
Ramos v. Neves, 2024 ONSC 3019: We successfully moved for a Certificate of Pending Litigation over a Toronto property
Markham Travel Health Clinic et al., v. Tians Medical Services Inc. et al.: We acted for the defendants, successfully resisting a motion for injunctive relief which alleged that the defendants failed to keep health information safely pursuant to the Personal Health Information Protection Act, 2004 and sought to prohibit the defendants from using the plaintiff’s business name
Rutherford Road Holdings Corp. v. Ocean Sands: We acted for the tenant plaintiff in a claim against a vendor and landlord and successfully obtained an order enjoining the defendants from repossessing property, taking assignment of subleases, and otherwise interfering with the plaintiff’s possession of the properties at issue
Jacobs v. McGee, 2023 ONSC 2765, leave to appeal denied, 2023 ONSC 4394 (Div Ct.) and 2023 ONSC 3427: We successfully resisted a motion for a Norwich Order in the context a series of related actions involving allegations of breach of fiduciary duties, misrepresentation, and defamation, among others. We also obtained a substantial costs indemnity order in respect of the motion and successfully resisted the motion for leave to appeal at Divisional Court
Up In Frames v. NYX Yonge Inc., 2022 ONSC 4795: We acted for a commercial tenant in restraining the developer landlord from prematurely terminating a lease to pursue a development
Riddell v. Huynh, 2022 ONSC 2153: Successfully resisted an urgent motion for a Certificate of Pending Litigation
DeGroote v. D.C. Entertainment et al: On behalf of billionaire philanthropist Michael DeGroote, who alleged he was defrauded of $118M, we obtained the appointment of a Receiver (2013 ONSC 7101), followed by the appointment of a Chief Restructuring Advisor (2014 ONSC 6146)
We have successfully obtained multiple Anton Piller orders (including orders to be executed contemporaneously at multiple locations) in internet piracy cases for a media and telecommunications company
We have successfully obtained urgent Court orders on behalf of beverage and food producers to test facilities of suppliers in various cases of food product recall
