We have extensive experience advising and representing professionals (and their companies/partnerships) as they navigate civil and regulatory proceedings. We have prosecuted and defended various professionals, including lawyers, engineers, accountants, architects, real estate agents, and health care providers governed by the Regulated Health Professions Act.
We understand the importance of providing prompt and wise advice to professionals whose livelihood may be at stake, and we are fearless in our representation of them in civil litigation and before professional bodies. We can also help if you are an individual who needs advice about pursuing a regulatory complaint or starting an action against a professional you believe has wronged you.
Our practice in this area includes:
Bringing and defending professional liability actions (including actions for negligence, breach of fiduciary duty, misrepresentation, etc.)
Representing and defending individuals at professional colleges in respect of inquiries, complaints, investigations, licensing matters, and disciplinary hearings
Extensive experience in health law and RHPA matters including defending and prosecuting in RHPA colleges, advice and representation on registration matters, responses to complaints, disciplinary proceedings, hospital privilege disputes, PHIPA disputes, quality of care reviews, and Coroner’s inquests
Appeals and judicial reviews of regulatory and administrative decisions including review hearings in front of the Health Professions Appeal and Review Board
Providing strategic crisis management for individuals or companies facing concurrent civil, regulatory and/or criminal proceedings
Director and officer liability
Providing regulatory advice to individuals, corporations and partnerships including law firms, architecture firms, engineering firms, accounting firms, and medical and health product clinics in Ontario
Applications and hearings before administrative tribunals
Advising individuals on commencing regulatory proceedings against professionals
