Justin Nasseri and Daniel Milton victory in 2025 ONSC 4240 (Aon Inc. v. City of Peterborough)

Congratulations to Justin Nasseri and Daniel Milton for their victory in 2025 ONSC 4240 (Aon Inc. v. City of Peterborough). Justin and Daniel successfully resisted a summary judgment motion by the municipality in a breach of contract action that our client issued against the city for the reconveyance of land at the south-west corner of Peterborough.

The City argued that the action should be dismissed because (i) the conditions precedent to sue for breach of contract had not materialized and (ii) that the action was statute-barred. The RN team successfully persauded the Court that there were genuine issues for trial with respect to both issues. While the City made submissions that this case was governed by the Limitations Act, 2002, the Court agreed with our client’s argument that the applicable limitation statute is the Real Property Limitations Act, which has a 10-year limitation period for actions to recover land.
